AI Decision Explanation Process

What this control does

Provide qualifying affected persons with clear and meaningful explanations of the AI system's role and the main elements of relevant decisions.

How to implement

For a deployer receiving a request for an explanation, assess whether the Article 86 right applies to the decision and AI system. Identify the affected decision, the role of the AI output and the main elements used by the decision-maker. Prepare a clear explanation for the person concerned, obtaining information from the responsible teams. Review statutory exceptions and any overlapping right under other Union law. Protect relevant confidential or personal information without using a generic disclaimer instead of the required explanation. Do not invent a universal response period where the applicable source does not provide one.

Suggested timing and triggers

On a qualifying request; within the period required by applicable law or process; periodic review of response quality.

Evidence examples

Request log and applicability decision Decision record and relevant AI-output information Approved explanation and delivery record Exception or overlapping-right assessment Follow-up questions and corrections

How to check this control

Select a completed request and compare the explanation with the actual decision record. Check that it explains the AI system's role and main decision elements, rather than providing only a generic description of the model.
