Emergency Conformity Derogation Governance

Control urgent use of high-risk AI under Article 46 derogation conditions, including authorisation and stop/discard requirements.

Use this control only for a legally available emergency conformity-assessment derogation, not as a general shortcut to deployment. Document the emergency, the applicable authority and the conditions for urgent use. Where Article 46(2) is relied on, request authorization without undue delay during or after use as provided by that route. If authorization is refused, stop the use and discard the results and outputs as required. For Annex I Section A product systems, assess the relevant sectoral derogation rather than assuming the general AI Act route applies.

Review an emergency case or exercise. Check the legal route, prompt authorization request and the ability to stop use and discard outputs following refusal. Confirm that the emergency procedure is not used for ordinary project delays.
